The European Network of (Ex-)Users and Survivors of Psychiatry (ENUSP), Mental Health Europe and the European Disability Forum (EDF) invite you to attend our memorial ceremony to honour the life and memory of our beloved and incredible activist Jolijn Santegoeds on 31st May from 14:00 to 15:30 CEST online via Zoom.
We will come together to remember Jolijn’s kindness, sense of justice and commitment to support and fight for our rights.

The aims of Stichting Mind Rights are:
a. to promote human rights and respectful care and equal participation in the community for persons who have (had) experiences with mental health care.
b. to oppose the use of coercion, means of coercion and coercive measures in all aspects of mental health care.
c. to promote the use of supportive treatment-alternatives instead of coercion and repression, and to promote the use of involvement of users and the use of expertise by lived experience in all aspects of mental health care.
d. to promote knowledge, information and education with regard to all aspects of mental health care, and with regard to policy making, social and cultural developments nd globalization in direct relation to care.
e. improvement of the overall quality of mental health care from a user perspective
f. to do all further acts that are stimulating or related to the above mentioned aims.
マインドライツの目的:
a.精神医療ケアを受けている人、受けた経験のある人の人権、丁寧なケア、地域への平等な参加を促進すること。
b.精神医療ケアのすべての面において、強制の使用、強制的な〔治療〕方法、強制的な検査に反対すること。

Abstract
Due to the progress being made in the neurosciences, higher expectations for the use of medication, even against the patient’s will, are arising in mental hospitals. In this article, we will discuss whether the neurosciences and new psychopharmacological solutions really support patients who suffer from mental illnesses. To answer this question, we will focus on the perspective of patients and their experiences with psychiatric (coercive) treatments. The analysis of one person’s story shows that other issues besides appropriate medication are important for recovery from a mental illness. In daily life, issues such as coping, rehabilitation and social support are of major importance for a patient suffering from psychiatric disease. Thus, although progress in the neurosciences is a positive development for clinical practice, it does not mean that (coercive) medication alone will carry a patient into recovery. A patient’s recovery is dependent, not only upon the process of finding the appropriate medication and trust between the psychiatrist and the patient, but also upon relational aspects, such as being recognised as a person, belonging, accepting responsibilities, developing friendships and trusting others. These findings lead to the conclusion that dealing with psychiatric diseases is more complex than what the biomedical model of neuroscience suggests and that one should include the social context of the patient in the recovery process.
神経科学の進歩によって、薬の使用への期待は、患者の意思に反してさえも、精神病院において高まっている。本稿では、神経科学と新しい精神薬理学による解決策が、精神病に苦しむ患者たちを本当に支えることができるのか検討する。この問いに答えるために私たちは、患者の視点と彼らの精神医療での(強制的な)治療の経験に焦点を当てた。一人の人の物語の分析からは、適切な薬であるかとは別に、精神病からのリカバリーには、〔神経科学的なアプローチの〕ほかのことが重要であることがわかった。日常生活において、問題の処理、リハビリテーション、社会的支援といったことは、精神病に苦しむ患者にとってとても重要なことである。このため、神経科学の進歩は臨床の実践のための前向きの発展であるけれども、それは(強制的な)投薬だけが患者にリカバリーをもたらすことを意味しない。患者のリカバリーは、適切な薬を見つけ、精神医療者と患者との信頼関係を築く過程だけでなく、人間として見られること、仲間に入ること、責任を認められることといった関係の面にもよっている。これらの結果から、精神病に対処することは神経科学の生物医学モデルが示しているよりも複雑で、患者のリカバリーの過程の社会的な文脈も考慮に入れるべきであると結論づけられる。

In 2013/2014, an alarming letter was sent to the Kingdom of the Netherlands, by the UN Special Rapporteur on Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (Mr. Juan E. Mendez) and the Special Rapporteur on the Right of Everyone to the Enjoyment of the Highest Attainable Standard of Mental and Physical Health (Mr. Anand Grover). In this letter these UN Special Rapporteurs express their worries about human right violations in the Netherlands by the use of forced treatments in psychiatry, in reference to the case of Jolijn Santegoeds.

Much has been written on the interrelatedness of mental health and homelessness, some arguing that mental health problems lead to homelessness, while others claiming that homelessness is a stress factor which provokes mental ill health. Although the direction of causality is not straightforward, the link clearly shows how mental health cannot be treated in isolation and how its wider social context, e.g. social status, poverty or social relations, has to be considered.
精神的な健康とホームレスとの関係については、たくさん言及されている。一方では、精神的な問題がホームレスを引きおこすのだと論じられ、他方では、ホームレスが精神病を引きおこすストレス因子であると論じられている。因果関係はわかりやすくはないけれども、その結びつきは、精神の健康は隔離状態では治療できないことや、社会的地位、貧困、社会関係といった幅広い社会的文脈が考慮されるべきであることを、はっきりと示している。

Summary
When I was 16, I experienced psychosocial problems. I was depressed and suicidal, which eventually led to forced institutionalization in a psychiatric facility in September 1994. I was perceived as a “danger to myself” because of self-harm. A number of forced psychiatric interventions followed, such as long-term seclusion, forced medication, restraint and forced body cavity searches. These measures made me feel more desperate and helpless, and therefore my psychosocial problems increased, along with my self-harm. This eventually led to a chain of escalation and repression, which I barely survived.
16歳のとき、私は精神的な問題を経験した。私は、憂鬱になり自殺してしまいたくなった。それは、結局、1994年の9月に精神医療施設への強制収容を招くことになる。私は、自傷していたから、「自分の危険性」に気づいていた。たくさんの強制的な精神医学の介入が続いた。長期にわたる隔離や、強制的な投薬、行動抑制、強制的な体の穴の探索などである。それらの方法は、私に、より絶望的に、そしてより無力に感じさせた。それによって、私の精神的な問題は自傷を伴って悪化した。これは最終的に、エスカレートしては行動抑制するという連鎖を生んだ。私はかろうじて生きていた。
The psychiatric interventions were done to prevent “danger” and to increase safety. However, these interventions did not make my situation safer, but resulted in more psychosocial problems which further escalated. The forced interventions did not improve my well-being, nor contribute to my recovery. They resulted in suffering, which is the opposite of care. These forced interventions left me helpless. They disabled meaningful contact with caregivers due to feelings of trauma, misunderstanding and distrust. The forced psychiatric interventions made me feel as if I was being punished for having psychosocial problems, and that took away my hope of inclusion and recovery.
精神医学の介入は、「危険性」を防ぎ、安全性を増すために行なわれた。しかし、それらの介入は私を安全にすることはなく、精神的な問題がより悪化するという結果を招いた。強制的な介入は、私の幸福を大きくしなかったし、リカバリーに貢献もしなかった。それらは、ケアとは反対に苦痛を生んだ。それらの強制的な介入は私を孤独のままにした。それらの介入は、トラウマや誤解や不信の感覚を抱かせることにより、治療者との有益な関係を作れなくした。強制的な介入は、私に精神的な問題を抱えていることを責められているように感じさせ、仲間に入ってリカバリーするという希望を消し去った。
A “miraculous recovery” at another psychiatric ward in 1996 shows that with a different attitude, my behaviour and my problems were not “unmanageable” as was said at the first institution.
1996年にもう一つの精神病棟での「奇跡的なリカバリー」は、違う態度でのぞめば、私の行動や問題は、最初の施設で言われていたように「手に負えない」ものではないということを示した。
この研修会は、オランダのEigen Kracht Centerから3人の講師を招聘し、ヨーロッパで実践されているFamily Group Conference(FGC)のその理論と実践を学び、成年後見に代わる新たな意思決定支援のあり方を学ぶものです。FGCとは、本人を支えるコミュニティーを再構築することで、一人では解決できなかった問題を解決できるようにする手法です。
FGCとは?
Family Group Conferenceとは、市民社会が持っているコミュニティーの力を復活させ、本人を支えるコミュニティーを再構築することによって、一人だけでは解決できなかった問題を解決できるようにする手法です。Familyといっても、家族という限定した意味ではなく、本人の身近な小コミュニティーの人たちの集まりという程度の、緩やかな意味です。この方法はニュージーランドやヨーロッパで成年後見制度に代わる本人中心の意思決定の支援方法として、すでに実践され始めています。児童や障害のある人に対する虐待、DV、さらに、判断能力が不十分だとされている人が権利侵害を受けるような状況にあったり、生活のバランスを極端に崩して生活が破綻してしまいそうな状況にある場合にも、修復的司法などに有効性が確認され、20年近い実践が重ねられています。
FGCは、成年後見制度のように法定の取消権や代理権によって、本人を頭越しに決定をしてしまうのではなく、本人を支えるコミュニティーを再構築することで、本人なりに考えて決められるようにし、あるいは、権利侵害や生活破綻などの問題状況そのものをFGCに参加する人のかかわりによって変えていく方法です。
